OA Strategy Briefs give you everything you need to respond to an office action, before you write a single word. Each brief bundles a plain-language summary of the office action, examiner analytics, art unit trends, similar case arguments, and recommended prosecution strategies into a single, ready-to-use file.
This article explains how OA Strategy Briefs are delivered and how to put yours to use once it arrives.
Before You Begin
OA Strategy Briefs are available for an extra fee for customers with access to the Office Action Response (OAR) module. Briefs are generated automatically whenever Juristat detects a new office action on a monitored application. Once generated and reviewed by the Juristat team, your brief is delivered directly to your inbox; there's nothing to configure or request on your end.
How You'll Receive Your Brief
When an office action is detected on one of your monitored applications, Juristat generates and reviews an OA Strategy Brief for that application. You'll receive an email with the brief attached as a markdown (.md) file once it's ready.
The email will include the application number and a summary of the office action type so you can quickly identify which application it's for.
Don't see an email for a recent office action? Check your spam or junk folder. If it's not there, reach out to Juristat Support at support@juristat.com and we'll look into it.
What's Inside the Brief
Once you open the file, you'll find the following sections:
Office Action Summary: A structured breakdown of all rejections (§102, §103, §112, double patenting, restriction), the cited prior art, affected claims, and the examiner's reasoning. This is a concise version of the full office action, optimized for quick review.
Examiner & Art Unit Analytics: Key stats on your examiner's behavior: allowance rates, how often they issue final rejections, RCE rates, and appeal outcomes. Art unit benchmarks are included for context.
Recommended Strategy: Data-backed guidance on likely successful paths, such as amendment-only vs. RCE vs. appeal, based on how similar cases resolved with this examiner and in this art unit.
Similar Cases & Example Arguments: References to comparable applications that faced the same rejection type, with summaries of the arguments or claim amendments that led to allowance.
Using the Brief with an LLM or Drafting Tool
The brief is able to be uploaded directly into any AI drafting environment: Claude, CoPilot, a firm's internal LLM tool, or any other platform you use. It's intentionally compact to preserve as much of the model's context window as possible for reasoning and drafting.
To get the best results, upload the brief and prompt your tool with a specific task, such as: "Based on this OA Strategy Brief, draft a response to the §103 rejection of claims 1–5."
